1. Scope

(2) For all offers, orders, deliveries, and services, we exclusively accept these terms and conditions in the version valid at the time the contract is concluded. We do not recognize customer conditions that contradict or deviate from our terms and conditions unless we have expressly accepted their validity in writing.

(4) If these General Terms and Conditions refer to the customer as “business customer” or “consumer,” the term “business customer” refers to natural or legal persons or partnerships who have legal capacity and, when entering into a legal transaction, act in the exercise of their commercial or independent professional activity. Consumers are exclusively natural persons who enter into a legal transaction for purposes that are not commercial or related to an independent professional activity.

(5) These terms and conditions also apply to all future transactions with the customer as far as they concern related legal transactions.

2. Order and Conclusion of the Contract

(1) The presentation of products in the online shop does not constitute an offer with any commitment, but rather an online catalog with no obligation to purchase. The information on each product should allow the buyer to make an informed choice.

(2) By ordering the products, the customer submits a binding offer to conclude a purchase contract for the ordered goods, to which they are bound for seven working days without refusal. Upon receipt of the order, the customer will receive an automatic confirmation of their order via email to the email address provided during the ordering process. If you order via the “credit card” or “immediate transfer” payment method, your order will be accepted immediately.

(3) The contract is concluded on the condition that we perform a correct and timely delivery. This applies only if non-delivery is due to an obstacle for which we are not responsible. The business customer will be immediately informed of the unavailability of the service. If the product has already been delivered, the payment will be refunded.

(4) Storage of the contract text: We store the contract text and send you the order details by email. The terms and conditions can be viewed at any time on this page. You can view your past orders in your customer account or request them from us via email.

3. Prices, Shipping Costs

(1) Unless explicitly stated otherwise, the prices displayed in our online store www.vaudrionbat.com are total prices, including shipping costs.

• Delivery is free for all orders.

(2) If the customer exercises their right of withdrawal, the customer will bear the shipping costs for returning the goods.

4. Payment Terms and Retention of Title

(1) For payments in our online store, the customer can use the following payment methods: instant bank transfer and credit card.

(2) If the customer chooses the “bank transfer” payment method, they will automatically receive a separate email after placing their order, specifying the amount to be paid and our bank details. The customer agrees to transfer the corresponding amount to our business account within five (5) business days after receiving this information. Once we have received the full payment into our account, we will process the order within two (2) business days.

(3) If the customer chooses the “credit card” payment method when placing their order, the customer will need to provide their credit card details. Once we have accepted the order, the payment amount will be debited from the credit card.

(5) Commercial customers are only entitled to compensation if their counterclaims are legally justified or undisputed. The customer may exercise a right of retention only to the extent that their counterclaim relates to the same contract.

(6) VAUDRION BAT reserves ownership of all goods delivered to a customer until full payment of the delivered goods is made.

5. Delivery and Shipping Conditions, Transfer of Risk

(1) The ordered items are delivered via the DHL shipping service. If the customer is a business customer, the risk of accidental loss or damage to the goods is transferred to them as soon as the goods leave the factory/warehouse. This applies regardless of the identity of the sender, whether the goods are shipped from the place of performance of the contract or from another location, and regardless of who bears the shipping costs.

(2) The customer guarantees that a complete and correct delivery address is provided. If the customer fails to provide a complete and correct delivery address, resulting in additional delivery costs, these will be borne by the customer.

(3) Upon receiving a delivery with visible transport damage on the outside, the customer agrees to note the damage on the delivery documents (e.g., delivery note, shipping receipt, delivery certificate) and have it confirmed in writing by the delivery person or driver.

(4) If the damage is not visible on the outside upon delivery, the customer agrees to immediately report the damage to us in order to file a claim with the delivery service.

6. Cancellation Conditions

(1) The right of withdrawal is exclusively available to consumers. You have the right to revoke this contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the day the customer or a third party designated by them, who is not the carrier, takes possession of the final goods. In order to exercise the right of withdrawal, the customer must inform us of their decision to cancel the contract by means of a clear statement via email. For this purpose, the customer can use the withdrawal form, although it is not mandatory. To meet the cancellation deadline, it is sufficient to send your cancellation notice before the withdrawal period expires.

(2) If the consumer cancels this contract, we must refund all payments they have made to us.

Once we receive and inspect your return, we will send you an email to inform you that we have received the returned item. We will also inform you whether your refund has been approved or rejected.

Refunds will be processed within 7 business days following the receipt of the returned item.

For this refund, we use the same payment method that the consumer used in the initial transaction, unless otherwise expressly agreed with the consumer.
